Protecting Our Community at Work

In our July 18 edition of Clear Actions, we highlighted the online trainings for organizing against ICE available from Siembra NC and Defend and Recruit.

Among the strategies Siembra and communities around the country are implementing is a campaign for 4th Amendment Workplaces.

The 4th Amendment of the US Constitution protects individuals and other private entities (like businesses) from “unreasonable search and seizures.” Here it is in full:

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

4th Amendment Workplaces are trained to know and exercise their right to be free from unwarranted searches and to protect their workers and customers in the same. A 4th Amendment Workplace:

  • Knows ICE needs a judicial warrant (not administrative) to enter private areas, and knows the difference between public and private space
  • Trains staff to assert their constitutional rights during search & seizure operations
  • Has protocols to protect employees and patrons
  • Protects all workers, regardless of immigration status
  • Defends dignity, safety, and rights at the door
